These terms govern your access to and use of the Travel Stay SA website and related services (the “Service”). By using the Service, you agree to these terms. If you do not agree, please do not use the Service.

1. What we provide

Travel Stay SA is an accommodation directory. We display information about properties and may facilitate ways for you to contact hosts. We do not act as a travel agent, tour operator, or party to any contract between you and a listed property unless we explicitly state otherwise in writing.

2. Listings and third parties

Listings, descriptions, prices, availability, and policies are provided by property hosts or their representatives. We aim to keep information useful and accurate but we do not guarantee that any listing is complete, current, or error-free. You should confirm important details (including price and house rules) directly with the property before booking or paying.

3. Your use of the Service

You agree to:

• Use the Service only for lawful purposes and in line with these terms;
• Not misuse the site (for example no scraping, hacking, spam, or attempts to disrupt the Service);
• Not submit false, misleading, or fraudulent enquiries or content;
• Respect intellectual property rights in our branding, design, and content.

4. Accounts

If we offer user accounts, you are responsible for safeguarding your login details and for activity under your account. Notify us promptly of any unauthorised use.

5. Enquiries and communications

When you contact a property through our Service, your message may be delivered to the host’s contact details they have supplied. We are not responsible for how hosts respond, for the outcome of any booking, or for disputes between you and a host.

6. Intellectual property

The Service, including its layout, logos, and original text, is owned by us or our licensors. You may not copy, modify, or distribute it without permission, except as allowed by law or for personal, non-commercial browsing.

7. Disclaimers

The Service is provided “as is” to the fullest extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement where allowed. We do not warrant uninterrupted or error-free operation.

8. Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service or any listing. Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the twelve months before the claim, or (b) where no fees apply, a reasonable cap as permitted by law.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law.

9. Indemnity

You agree to indemnify and hold us harmless against claims arising from your breach of these terms, your misuse of the Service, or your dealings with third-party hosts, to the extent permitted by law.

10. Changes

We may modify these terms or the Service. We will indicate material changes where required. Continued use after changes constitutes acceptance of the updated terms.

11. Governing law

These terms are governed by the laws of South Africa, unless mandatory consumer protections in your country require otherwise. Courts in South Africa have non-exclusive jurisdiction, subject to those protections.
